Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Giggles Platonic Dating Services Private Limited (“Giggles,” “we,” “us,” or “our”) platform, including our mobile application and website (collectively, the “Services”). By accessing or using our Services, you agree to these Terms. If you do not agree, you must discontinue using our Services immediately.

 

1. Definitions

  1. “Platform” refers to the Giggles mobile application and website.

  2. “User” refers to individuals who create an account or interact with the Giggles platform.

  3. “Content” includes all text, images, videos, and other material on the platform, whether provided by Giggles or its users.

  4. “Aadhar Verification” refers to the mandatory process of validating a user’s identity via their government-issued Aadhar ID.

 

2. Eligibility

  • Age Restriction: Users must be at least 18 years old to register or use the Services.

  • Account Authenticity: Users agree to provide accurate and complete information during registration. Falsifying identity, including misuse of Aadhar, is strictly prohibited.

  • Prohibited Persons: Individuals previously banned from the platform or found violating these Terms are not eligible to use the Services.

3. User Obligations

  • Account Security: Users are responsible for maintaining the confidentiality of their login credentials. Sharing credentials is prohibited.

  • Behavior Standards: Users must respect others and refrain from offensive, harassing, or unlawful behavior.

  • Content Ownership: Users retain ownership of the content they upload but grant Giggles a non-exclusive license to use, display, and share it as required for the platform's operation.

  • Prohibited Activities: Users shall not:

    • Use the platform for commercial purposes.

    • Post defamatory, obscene, or misleading content.

    • Engage in fraud, impersonation, or illegal activities.

 

4. Aadhar Verification and Data Privacy

  • Mandatory Aadhar Verification: All users must complete Aadhar-based identity verification during registration.

  • Data Usage: Aadhar information is encrypted and used solely for verification purposes. It is neither stored beyond necessity nor shared with unauthorized parties.

  • Compliance with DPDP Act: Giggles ensures compliance with the Digital Personal Data Protection Act, 2023, including:

    • Secure processing of personal data.

    • User rights to access, modify, or delete their data.

  • Legal Disclosure: Data may be disclosed to law enforcement under applicable laws, including the IT Act, 2000.

5. Safety and Security Features

  • SOS Feature: Users can activate the in-app SOS feature during emergencies, sharing real-time location data with Giggles’ monitoring team and SecureHub personnel.

  • SecureHub Support: Giggles provides on-ground support through its SecureHub network to ensure safety during interactions.

  • Reporting Mechanisms: Users can report suspicious or inappropriate behavior via the in-app reporting feature.

 

6. Subscription and Payment

  • Subscription Plans: Giggles offers monthly subscription plans of ₹5000 for men and ₹2000 for women, subject to periodic discounts.

  • Refund Policy: Subscription fees are non-refundable unless mandated by law.

  • Payment Security: All payments are processed securely, complying with industry standards and applicable laws. Giggles does not store sensitive payment information.

7. Limitation of Liability

  • Platform Use: Giggles is not liable for any damages arising from user interactions, including disputes or conflicts between users.

  • Emergency Situations: While we strive to provide timely SOS support, we do not guarantee resolution of emergencies beyond our reasonable control.

  • Third-Party Services: Giggles is not responsible for services or content provided by third-party partners or affiliates.

8. Intellectual Property

  • Ownership: All intellectual property rights related to the platform, including its logo, design, and code, are owned by Giggles.

  • User Content: By posting on the platform, users grant Giggles a limited license to use their content for promotional or operational purposes.

  • Infringement: Unauthorized use or reproduction of Giggles’ intellectual property is strictly prohibited.

 

9. Termination and Suspension

  • Account Termination: Giggles reserves the right to terminate or suspend user accounts for violations of these Terms or applicable laws.

  • User-Initiated Termination: Users may deactivate or delete their accounts through the settings page.

  • Effect of Termination: Upon termination, access to the platform is revoked, but any obligations incurred prior to termination remain enforceable.

 

10. Indemnification

Users agree to indemnify and hold harmless Giggles, its affiliates, and its employees from any claims, liabilities, or damages arising from:

  • Misuse of the platform.

  • Breach of these Terms.

  • Violation of any law or third-party rights.

 

11. Amendments and Updates

  • Policy Changes: Giggles reserves the right to update these Terms. Users will be notified of significant changes via email or app notifications.

  • Acceptance of Changes: Continued use of the platform after updates constitutes acceptance of the revised Terms.
     

12. Governing Law and Jurisdiction

  • Applicable Law: These Terms are governed by the Indian IT Act, 2000, the Digital Personal Data Protection Act, 2023, and other relevant laws.

  • Dispute Resolution: All disputes shall be subject to arbitration in [Insert City], India, as per the Arbitration and Conciliation Act, 1996.

13. Miscellaneous

  • Severability: If any provision of these Terms is found invalid, the remaining provisions shall continue in effect.

  • No Waiver: Failure to enforce any provision does not constitute a waiver of rights.

  • Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between the user and Giggles.
